Miami Vytorin Lawsuit Lawyer

Freidin Brown, P.A. is investigating whether Merck and Schering-Plough, the manufacturer of Zetia and Vytorin, were aware since at least 2006 that the combination of drugs was no more effective than the generic version of Zocor in blocking the fatty arterial plaques that can cause heart attack and stroke, as they led consumers to believe in marketing the drugs.

A recent clinical trial showed that the generic statin Vytorin, a cholesterol drug developed by Merck and Scherning -Plough Corp. did not reduce harmful plaque building in the arteries which is a leading indicator of a heart attack or stroke. The companies conducted a two-year (2004-2006) clinical trial of the drug’s effectiveness on lowering and reducing cholesterol in the hopes the results would strengthen their marketing efforts.

What Is Vytorin?

Vytorin, a generic statin, is the combination of Zetia and Zocor. Vytorin is used by millions of patients and brought Merck and Scherning -Plough Corp. more than $5 billion in sales last year.

The results shocked the medical community and the patients who took Vytorin to help reduce their:

  • Cholesterol
  • Plaque build-up
  • Chances of a heart attack or stroke

Even more disturbing is that the drug makers sat on the results for more than one year. A House committee will explore whether Merck and Scherning-Plough Corp. withheld the results lest they interfere with sales and only released the clinical trial data under pressure from Congress and news media reports.

Patients feel that the drug makers misrepresented the safety and efficacy of the drug and that the results of the clinical trial were purposely concealed and delayed in order to enhance sales of the drugs. Many feel that Merck and Scherning -Plough Corp. should reimburse patients, their insurance or Medicare for the costs of the drugs.
