For example, cerebral palsy may be caused by brain damage when doctors or nurses fail to monitor signs of fetal distress during labor, improperly use devices such as forceps or vacuum extractors, or fail to perform a timely C-section when medically warranted, among other causes. While the condition can range in severity, it has no cure and creates a lifetime of limitations and increased medical needs, making full and fair compensation vital in cases where it could and should have been prevented.
  • Erb’s Palsy Erb’s palsy is a common preventable birth injury caused by injuries to the brachial plexus band of nerves which travel through the shoulder and controls movements of the arm. Often it results from excessive force applied during birth, such as pulling on a baby’s neck or arms, shoulder dystocia, and improper use of forceps and vacuums. It may also be caused by certain acts of substandard medical care, such as when doctors fail to correctly assess the size and positioning of a baby in the whom, potential pregnancy complications, and the need for a C-section as compared to traditional birth.
  • Brain injuries – Brain injuries that arise from birth trauma are among the most serious birth injuries in Florida and are unfortunately not that uncommon. While cases can vary, these types of injuries typically involve hypoxic-ischemic encephalopathy (HIE), which is caused by oxygen deprivation to a fetus or a newborn’s brain. When this occurs, a lack of oxygen and blood flow to the brain can result in serious injuries, including the development of various disabilities, cerebral palsy, sensory impairment (vision and hearing), learning disabilities, and more.
