Although the tobacco companies immediately appealed and the jury overturned the decision in 2004, reversing the award, members of the original class were able to file individual cases. As a result, the court allowed matters already decided in the class action lawsuit to hold true for the individual lawsuits, including findings that tobacco products are defective, dangerous, addictive, and the cause of various illnesses.
