It was the worst day of her brother's life. Last October, a 21-year-old woman was killed by a drunk driver. When the police informed her brother, he didn't know what to do. Eventually, he and the woman's father decided to file a wrongful death lawsuit.
The young woman was in a car with her boyfriend when a young driver, also 21, in a pickup truck struck the driver's side door of their car. The young woman and her boyfriend were dead at the scene of the crash.
The pickup truck driver was injured in the crash and taken to the hospital. It was there that police officers reported that he smelled of alcohol. He was charged with DUI, and later indicted on two counts of vehicular homicide. He is now serving a jail sentence for the criminal offenses.
Miami wrongful death attorneys have noted that the wrongful death lawsuit filed by the woman's father and brother seeks unspecified damages from three separate defendants: the drunk driver, the drunk driver's brother, who owned the pickup, and the bar where the drunk driver was drinking just before the crash. The lawsuit alleges that the bar overserved the man who soon after got into his pickup and caused the crash.
The woman's brother said, "I wish the sports bar and the people serving him would have done something. Called the police, let the manager know they had someone that is obviously intoxicated. I believe, without this bar serving him this amount of liquor, this would not have happened."
The pickup truck driver was served papers in the wrongful death lawsuit in his jail cell.
