An Alabama jury recently awarded $16 million in damages to a woman who suffered extreme physical and emotional injuries during delivery. The case, which was resolved earlier this month, was filed over a traumatic birth experience that occurred in 2012. In that delivery, a 32-year-old mother suffered injury and serious distress during what should have been a comforting and natural birth.
According to court documents filed in the case, the mother had decided to switch from the hospital used for her previous three births to another hospital that took a less medicalized and more natural approach to delivery. Unfortunately and despite promises from the hospital that mothers had the ability to control their birth, the mother in this case faced numerous aggressive medical interventions, including being forced to remain on her back and nurses holding her crowning child’s head in place until a doctor arrived.
As a result of the “bait-and-switch” maternity care and traumatic birth, the mother was left with a debilitating medical condition that has seriously impacted her quality of life. She now sees a therapist and must take medications for both her pain and panic attacks. Ultimately, the jury found that the hospital violated the accepted standard of care for labor and delivery and was responsible for reckless misrepresentation of fact. The hospital has faced other allegations from women who have suffered similar experiences.
