Carbon Monoxide Can Injure, Kill Floridians

Property owners are required by law to ensure to the best of their ability that their property is safe for anyone who lives, works or visits there. At Freidin Brown, P.A., we work to hold property owners liable for any negligence that has caused personal injury or wrongful death.

People often associate this area of law, which is called premises liability, with things like slip and fall accidents, drownings and lack of security. It does encompass all of those things and more.

For example, property owners can and have been held responsible for carbon monoxide poisoning. In another state, the family of a couple who perished due to carbon monoxide poisoning in a hotel room is suing the corporation that owns the hotel as well as other defendants. The suit contends that the exhaust ventilation system for the pool caused the deadly gas to fill the couple's room, which was located above the pool's equipment room. The plaintiffs also claim that the hotel rooms had no carbon monoxide detectors.

Our firm is not involved in this case, but we have successfully represented clients who brought suit against large property owners for injury resulting from carbon monoxide poisoning.

Carbon monoxide is not only highly poisonous, but it inhibits the flow of oxygen to the blood. It can be produced when various fuels are not completely burned. Because it is colorless, odorless and tasteless, without proper detection devices, people may have no idea that they are being exposed to it. Because the symptoms, which include can weakness, fatigue, difficulty breathing, headaches and chest pains, can resemble other conditions, victims may not realize that they have been poisoned, sometimes until it is too late.

If you or a loved one has been injured or killed due to carbon monoxide poisoning that you believe was the fault of a property owner, contact our office to schedule a free initial consultation. Because we handle all premises liability cases on a contingency fee basis, our clients in these cases pay us nothing in legal fees until and unless we make a recovery for them.
