Faulty strollers recalled after reports of fingertip amputations

Parents in South Florida and around the country heard alarming news recently involving strollers manufactured by Graco Children's Products. The company, as we discussed here, was in the news earlier this year for problems with its car seats. Now, it has recalled approximately 4.7 million of its strollers in the U.S. Over 200,000 additional strollers have been recalled in Canada and over 10,000 in Mexico. The recall impacts 11 models sold under the brand names of Graco and Century.

The reports of injuries to children are truly disturbing. The company has reportedly been notified of six fingertip amputations, four partial amputations and one laceration caused by a folding side hinge on the stroller.

The recalled strollers were sold at major retailers including Toys R Us, Walmart and Target. The impacted products, which include travel system strollers, were sold between Aug. 2000 and September of this year.

Graco says it will provide consumers with a repair kit for the hinges free of charge in December. In the meantime, the U.S. Consumer Product Safety Commission has advised parents and other caregivers to use "extreme care when unfolding the stroller to be certain that the hinges are firmly locked before placing a child in the stroller." They have also advised them to "immediately remove the child from a stroller that begins to fold…."

The CPSC provides a detailed list of model names and numbers on its website. There is no mention on the site of whether customers can return their recalled stroller for a refund or replacement.

While no amount of compensation can make up for a disfiguring injury to a child caused by a dangerous or defective product, parents can and should seek legal guidance to determine whether they can seek civil legal action against a manufacturer. Companies that sell products that can injure or maim children can be held liable for medical costs, pain and suffering and other damages.
